    • Abstract:
      The article discusses the lack of judicial consideration and analysis accorded to Aboriginal traditional health beliefs in Australia. For example, there is a significant difference in Aboriginal culture with respect to who has the right to make decisions about another's health care. While Australian health law respects the competent adult's right to make decisions or their lawfully appointed surrogate should they lack capacity, in Aboriginal culture such decisions are shared with the family, often including extended kinships.
